A power of sale happens when a borrower defaults on their mortgage and the lender exercises its contractual right to sell the property and recover the debt. It is the most common route for distressed sales in Ontario, and it is not the same thing as a foreclosure: under a power of sale the homeowner keeps title until closing and receives any surplus left after the mortgage debt and selling costs are paid, while a foreclosure transfers ownership to the lender through the courts.
Power of sale listings are marketed through the normal MLS® process, so they appear on this page alongside a listing brokerage like any other property. The seller is obligated to seek fair market value, which means steep automatic discounts are less common than many buyers expect. Most of these properties are sold as-is, without the warranties or repairs a typical seller might offer.
If you are considering a power of sale purchase: budget for a thorough home inspection where one is possible, have a lawyer review the agreement before you waive conditions, and arrange financing early since closing timelines can be firm.
