How power of sale works in Ontario
A power of sale happens when a borrower defaults on their mortgage and the lender exercises its contractual right to sell the property and recover the debt. It is the most common route for distressed sales in Ontario, and it is not the same thing as a foreclosure: under a power of sale the homeowner keeps title until closing and receives any surplus left after the mortgage debt and selling costs are paid, while a foreclosure transfers ownership to the lender through the courts.
Power of sale listings are marketed through the normal MLS® process, so they appear on this page alongside a listing brokerage like any other property. The seller is obligated to seek fair market value, which means steep automatic discounts are less common than many buyers expect. Most of these properties are sold as-is, without the warranties or repairs a typical seller might offer.
If you are considering a power of sale purchase: budget for a thorough home inspection where one is possible, have a lawyer review the agreement before you waive conditions, and arrange financing early since closing timelines can be firm. Frequently asked questions
- How many power of sale properties are for sale in Collingwood, Ontario?
- As of November 2026, haho.ca lists 2 power of sale properties for sale in Collingwood, Ontario, with a median asking price of $1,799,000. This page updates as listings come on and off the market.
- How much does a power of sale property cost in Collingwood, Ontario?
- The median asking price for power of sale properties in Collingwood, Ontario is currently $1,799,000, based on 2 active MLS® listings.
- Is a power of sale the same as a foreclosure?
- No. In an Ontario power of sale the borrower keeps ownership until the sale closes and receives any surplus after the debt and costs are paid. In a foreclosure the lender takes title through a court process. Power of sale is by far the more common of the two in Ontario.
- Are power of sale properties cheaper than regular listings?
- Not automatically. The seller must take reasonable steps to obtain fair market value, so most power of sale properties list near market price. The potential value usually comes from motivated timelines and as-is condition, which suits buyers who can price in repairs.
- What should I watch out for when buying a power of sale property?
- Properties are typically sold as-is with no warranties, interior access for inspections can be limited, and the original owner may redeem the mortgage before closing, which cancels the sale. Work with a real estate lawyer and get your financing in place early.
